Obamacare Ruled Unconstitutional

The eleventh Circuit Court of Appeals has upheld Judge Roger Vinson’s ruling that the “Patient Protection and Affordable Care Act” is unconstitutional in the case brought by Florida and 25 other states, two private citizens, and the National Federation of Independent Business. It was a good start toward recognizing individuals’ and states’ rights, according to Dr. Tamzin Rosenwasser, of the Association of American Physicians and Surgeons.

But in her opinion,  the ruling stopped short of what it should have been, because the powers of the federal government do not extend to interference in medical care. “As the 10th Amendment states,” she says, ‘The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.’”
